AN AGE DISCRIMINATION CLAIM

An Employment Tribunal in the city of Manchester has found that an experienced solicitor was rejected for employment by a law firm on the basis that he was too expensive, a statement which the tribunal ruled amounted to age discrimination.

The judgment stated that the claimant's age either contributed to, or was the principal reason for, the firm's decision not to appoint him as a solicitor, despite the claimant being the only job (1) ….. to apply for the vacancy.

At the time of his interview with the firm in March 2018, Mr Levy was 57 years old. He had been a (2) ….. lawyer since 1985, and the position he applied for sought someone with at least five years' post-qualification experience (PQE). It is normal practice for a law firm, when advertising legal positions, to require a certain number of years' PQE. The interviewing manager, Ms Udalova-Surkova, told him that the firm, McHale Legal, needed to hire someone fairly urgently because a senior associate was leaving the firm and work was piling up as new (3) ….. from clients came flooding in.

Ms Udalova-Surkova asked Mr Levy at interview what annual salary he was seeking. He suggested that the salary of the departing associate could form a starting point for discussing his requirements. In fact, that associate had an annual salary of £42,000, but Mr Levy suggested that he would be able to work for £50,000. The tribunal heard that on the day after the interview, Ms Udalova-Surkova (4) ….. a meeting with the firm's other heads of department to discuss the role. Notes from this meeting produced as part of the legal (5) ….. process suggested that Mr Levy was expensive, and additionally, doesn't (6) ….. all of our needs. Mr Levy then received an email saying that his application had been unsuccessful. It said ‘I regret to inform you that at this stage we would not require your services, as we have decided to go for a 3-5 PQE solicitor to train to our specific requirements’. Mr Levy subsequently (7) ….. a claim for age discrimination against the firm.

The (8) ….. for a breach of employment law in the UK is usually an award of damages rather than an Order of Specific Performance. This is because the courts are reluctant to force the parties into close relationships which may well (9) ….. rise to further problems in future. In total, Mr Levy was awarded £13,188 for loss of (10) ….. , injury to feelings and aggravated damages.
